What if having a virus sent you to prison? Currently there are 32 U.S. states and territories that have laws expressly criminalizing HIV exposure and/or nondisclosure of HIV status. Many prosecutions under these laws take place even when no transmission occurred or was possible, as in cases of spitting, biting, or fights. Criminalizing HIV defies science and public health, and deters HIV testing and treatment.
